Terms of Service

These Terms of Service govern your use of the Nouriva mobile application, website, and all services offered therein. By accessing or using our platform, you agree to be legally bound by these terms. If you do not agree, please do not use the service.

1. User Eligibility

You must be at least 18 years old to use the app or place an order. By registering an account, you confirm that the information you provide is accurate and that you are legally allowed to enter into this agreement.

2. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify Nouriva immediately of any unauthorized use or suspected breach. Nouriva is not liable for losses caused by your failure to safeguard your account.

3. Service Scope

Nouriva provides a digital platform for users to order meals, request delivery, and access information about East African fast food. The availability of items and services is subject to location, stock, and operational constraints.

4. Ordering & Transactions

All orders are placed via the Nouriva mobile app. Once you place an order and complete payment, you will receive a confirmation. Nouriva reserves the right to cancel or modify orders due to unavailability, errors in pricing, or logistical issues. Orders cannot be modified after the preparation stage has begun.

5. Pricing & Payments

All prices are listed in Kenyan Shillings (KES) and include applicable taxes unless otherwise stated. Payments must be made via approved mobile money, debit/credit card, or in-app wallet services. Payment providers may charge additional fees based on their terms.

6. Refunds & Cancellations

Refund eligibility and cancellation terms are defined in our Refund & Cancellation Policy. Refunds will only be processed via the original payment method and may take 3–5 business days to reflect.

7. Delivery Service

Deliveries are fulfilled by our local rider network. You agree to provide accurate delivery information and to be available at the location upon delivery. Nouriva is not liable for delivery failure due to customer unavailability, incorrect addresses, or blocked access.

8. User Conduct

You agree not to misuse the platform, disrupt services, defraud other users, or violate local laws. Any abusive behavior towards staff or riders may lead to account suspension or legal action.

9. Intellectual Property

All content on the Nouriva platform — including brand elements, images, menus, and code — is the property of Nouriva or its licensors. You may not reproduce or use any material without written permission.

10. Service Interruptions

We strive for uninterrupted access, but we do not guarantee availability at all times. Nouriva may suspend service temporarily for maintenance, upgrades, or emergencies without prior notice.

11. Termination

We reserve the right to terminate or suspend your account at any time, with or without notice, for violation of these terms or for suspicious behavior. You may also delete your account by contacting our support team.

12. Governing Law

These terms are governed by the laws of Kenya. Any disputes will be handled by courts located within the jurisdiction of Turkana County or Nairobi, unless otherwise agreed in writing.

13. Updates to Terms

Nouriva may update these Terms of Service at any time. Continued use of the app after updates means you accept the revised terms. Please check this page regularly.
